Entrant must own or otherwise have the right to submit the photograph for consideration. By submitting the photograph, entrant affirms, represents and warrants that entrant has such rights. If the photograph contains any material or elements that are not owned by the entrant and/or which are subject to the rights of third parties, and/or if any persons other than the entrant appear in the photograph, the entrant is responsible for obtaining, prior to submission of the photograph, any and all releases and consents necessary to permit the exhibition and use of the photograph in the manner set forth in these Official Rules. If any person appearing in any photograph is a considered a minor in their jurisdiction of residence, entrant is responsible for obtaining, prior to submission, the consent of the minor’s parent(s) or legal guardian.
By submitting a photograph, entrant grants an irrevocable, perpetual, worldwide non-exclusive license to CBMM and its agents to reproduce, distribute, display and create derivative works of the entries (along with a name credit when in CBMM’s sole opinion a name credit is feasible and/or otherwise appropriate) in connection with Snapshots to Selfies, the promotion thereof and/or any other use consistent with CBMM’s mission, in any media now or hereafter known, including, but not limited to: display at the Exhibition, publication in print media, publication online, promotional materials and/or merchandise. Display or publication of any entry on CBMM’s website and/or in print materials does not indicate the entrant’s photograph will be included in the Exhibition. CBMM reserves the right to modify the caption provided by the entrant with the submission of the photograph. Notwithstanding the grant of the license 3 described in this paragraph, entrant shall retain all other rights to the submitted photograph including, if applicable, their copyright.
LIMITATION OF LIABILITY
By submitting a photograph for consideration, all entrants agree to release, discharge, and hold harmless CBMM and its partners, affiliates, subsidiaries, agents and their employees, officers, directors, and representatives from any claims, losses, and damages arising out of their participation in Snapshots to Selfies or any related activities. CBMM assumes no responsibility for any error or omission, any theft or destruction of or unauthorized access to entries or entry forms, or alteration of entries or entry forms. CBMM is not responsible for any technical malfunction or the failure of any entry to be received. CBMM is not responsible for any injury or damage to entrants' or any other persons' computers related to or resulting from participation, or the uploading or downloading of any materials related to Snapshots to Selfies.
Entrant agrees that all matters related to Snapshots to Selfies and their participation therein shall be governed by and construed and enforced in accordance with the laws of the State of Maryland. Entrant further agrees to be bound by these Official Rules, and that all decisions made by CBMM relating to the Snapshots to Selfies are final and uncontestable. CBMM reserves the sole and absolute right to disqualify any entry for any reason or no reason at all. The failure by CBMM to enforce any of the rights set forth herein does not constitute a waiver of those rights.
RIGHT TO CANCEL EXHIBITION
CBMM reserves the right to cancel or modify the Exhibition, and/or the Term for Submissions set forth in these Official Rules, with or without notice.
Entrants agree that personal data may be processed, shared, and otherwise used for the purposes and within the context of Snapshots to Selfies and any other purposes outlined in these Official Rules.
“To be considered for Snapshots to Selfies, a photograph must: (You may submit up to three)
(i) document a summer moment
(ii) be taken during or after 1965
(iii) feature the Chesapeake Bay and/or a tributary of the Chesapeake Bay
(iv) feature a human being(s)
(v) comply with the terms of the “Release” paragraph set forth below
(vi) be in a digital format (.jpeg, .png, or .tiff) with a resolution of 300 dpi or greater (though lower resolution photographs may be accepted and used on the CBMM website)
(vii) must not be extensively manipulated (only minor burning, cropping, dodging and/or color correction is acceptable).”
